EEO Plans

Under the NSW Anti-Discrimination Act 1977, departments and agencies can conduct EEO programs for certain disadvantaged groups, including people with a disability.

Part 9A of the Act places a statutory obligation on all Public Sector agencies to implement EEO planning to eliminate unlawful discrimination in employment practices and to promote employment opportunities to job seekers and employees with a disability.

Departments and agencies are required under the NSW Anti-Discrimination Act 1977 122J to prepare an EEO Management Plan and lodge it with the Public Service Commissioner. Departments and agencies are required to update their plans to incorporate all relevant actions included in EmployABILITY.

In addition, the Commonwealth Disability Discrimination Act 1992, Part 3 requires departments and agencies to prepare an action plan.

The current Disability Action Plans (DAP) Guidelines developed by Ageing, Disability and Home Care has five elements, including employment. To avoid duplication the department or agency EEO Management Plan can be referenced for this element of the DAP.
